1. Acceptance

By creating an account, purchasing, or using JobAlchemist (the "Service"), you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you confirm you meet this requirement.

If you use the Service on behalf of an organisation, you confirm you have the authority to bind that organisation.

Where the Service is available

JobAlchemist is generally available worldwide, except where we decide to restrict access. We don't represent that the Service is appropriate or available in every country, and availability may vary over time.

Not available in the UK/EU/EEA

We do not offer the Service to individuals located in the United Kingdom or the European Union/EEA. We use measures such as IP addresses and billing details to help identify location, but these are not perfect.

3. What we provide (and what we don't)

JobAlchemist helps you analyse job advertisements, organise your job search, and generate or improve application materials using software and AI.

You understand and acknowledge:

  • We are not an employment agency, recruiter, or legal advisor. We're not providing professional HR, immigration, financial, or tax advice either.
  • We don't guarantee interviews, job offers, employment outcomes, or salary results.
  • AI-generated outputs are for information and drafting assistance only.
  • You are responsible for reviewing, verifying, and deciding how to use anything produced by the Service.

4. Your account

You agree to:

  • Provide accurate and current information when creating your account
  • Keep your details up to date
  • Keep your login credentials secure and do not share them
  • Tell us promptly if you suspect unauthorised access

You're responsible for activity on your account, whether or not you authorised it.

5. Your content

"User Content" means all information, data, text, documents, and files you upload, enter, or provide (including CVs/resumes, cover letters, job ads, notes, and other materials).

Ownership: You keep ownership of your User Content.

License to operate the Service: You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, display, and transmit your User Content only to:

  • operate, maintain, and secure the Service
  • provide features you request (including generating AI outputs)
  • provide customer support
  • perform quality checks and improve features using de-identified or aggregated data where practicable
  • comply with legal obligations

This licence ends when you delete the relevant User Content or close your account, except where we need to keep copies for legal, security, fraud-prevention, backup, or billing purposes (as described in our Privacy Policy).

Your responsibilities: You confirm that:

  • you own or have the rights needed to upload and use your User Content
  • your User Content doesn't infringe others' rights (including IP and privacy rights)
  • your User Content doesn't contain malware or malicious code
  • you won't upload unlawful, harassing, defamatory, or abusive content

6. AI features and outputs

When you use AI-powered features, we may send relevant parts of your User Content and context to third-party AI providers to generate the output you requested.

AI-generated content:

  • may be inaccurate, incomplete, or misleading
  • may reflect biases
  • may require editing and personalisation
  • may not match a specific employer's preferences or the latest best practices

You are responsible for:

  • reviewing AI outputs before use
  • verifying factual claims and suitability
  • ensuring your application materials accurately reflect your real experience

AI can sometimes generate false or incorrect statements.

AI training: We do not use your individual User Content to train third-party providers' general-purpose AI models. We may use aggregated or de-identified information to evaluate and improve the Service.

7. Acceptable use

You must not:

  • use the Service unlawfully or to harm others
  • upload malware or malicious code
  • attempt to bypass security measures or access other users' data
  • scrape or data-mine the Service using automated tools (unless we explicitly permit it)
  • reverse engineer or attempt to derive source code
  • upload content you don't have rights to use
  • use the Service to generate deceptive, fraudulent, or harmful content
  • impersonate others or misrepresent affiliation
  • share or resell access without permission
  • create multiple accounts to evade limits or billing

Location controls

You must not try to bypass location restrictions (for example, by using a VPN to disguise your location).

We may suspend or terminate access if we reasonably suspect misuse. We'll usually provide notice where practicable, unless urgent (security, abuse, legal).

8. Purchases, subscriptions, and billing

Payments

Paid features may be offered as subscriptions and/or one-off purchases. Prices are shown at checkout and may include applicable taxes (including GST where required).

Payments are processed by Stripe. We don't store full payment card details. By purchasing, you authorise us (and Stripe) to charge the amount shown.

Subscriptions

Subscriptions renew automatically each billing period until you cancel.

Cancellation: You can cancel at any time in your account settings. Cancellation takes effect at the end of the current billing period. You keep access until then.

Price changes: We may change prices with reasonable prior notice (generally at least 30 days). Changes apply on renewal. If you don't accept a price increase, you can cancel before it takes effect.

One-off purchases

One-off purchases are non-recurring. Access and entitlements are described at purchase time.

Refunds

Change of mind

We generally don't provide refunds for change of mind.

Billing mistakes

If you're charged in error (for example, duplicate charges), we'll fix it and refund the incorrect amount.

Faulty service / statutory rights

Nothing in this refund section limits your rights under applicable consumer laws (including the NZ Consumer Guarantees Act and Australian Consumer Law). If the Service is faulty or not provided with reasonable care and skill, you may be entitled to remedies.

To request a refund, contact hello@jobalchemist.tech with your order details. We aim to respond within a reasonable time (often 5–7 business days).

Payments from unsupported regions

If a payment is attempted from an unsupported region, we may block it. If we later discover a purchase was made from an unsupported region (including the UK/EU/EEA), we may cancel access and refund the most recent charge (or provide a pro-rated refund/credit where appropriate), unless we must do something different to prevent fraud or comply with payment rules.

9. Service availability and changes

We aim for reliable access, but the Service may occasionally be unavailable due to maintenance, outages, third-party dependencies, or events outside our control.

We may modify, suspend, or discontinue features or the Service. If we materially reduce core paid functionality you've purchased, we may notify affected users and may offer a pro-rated credit or refund, depending on the circumstances and your statutory rights.

10. Third-party services

The Service relies on third parties for hosting, database/auth/storage, AI processing, payments, analytics, and email. Their services are governed by their own terms and policies. We aren't responsible for third-party services outside our reasonable control, but we select reputable providers and take reasonable steps to protect data as described in our Privacy Policy.

11. Intellectual property

We (or our licensors) own all IP in the Service (software, workflows, templates, UI, branding, logos, documentation), excluding your User Content.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal job search in line with these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works from the Service, or use our branding without permission.

12. Feedback

If you provide feedback, you allow us to use it to improve the Service without obligation to you.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We don't make warranties that the Service will be uninterrupted, error-free, or that outputs will be accurate or suitable for your purposes.

Nothing in these Terms excludes guarantees or remedies that can't legally be excluded (including under the NZ Consumer Guarantees Act and Australian Consumer Law).

14. Consumer law (New Zealand)

Nothing in these Terms limits rights you have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other non-excludable consumer protections.

14A. Consumer law (Australia)

Our services come with guarantees that can't be excluded under the Australian Consumer Law. If we fail to comply, you may be entitled to remedies. To the extent the ACL permits limiting liability for a failure to comply with a consumer guarantee, our liability is limited (at our option) to re-supplying the services or paying the cost of having them supplied again.

15. Limitation of liability

To the maximum extent permitted by law and subject to Sections 14 and 14A:

  • We're not liable for indirect or consequential losses (like lost opportunities, lost profits, reputational harm), except where the law doesn't allow us to exclude them.
  • Cap on liability: Our total aggregate liability to you for all claims relating to the Service is limited to the amount you paid us for the Service in the 3 months immediately before the event giving rise to the claim.

Nothing in this section limits liability that cannot be limited by law (including for fraud, or for death/personal injury caused by negligence).

16. Indemnity

Consumer-safe framing

If you use the Service in a business capacity, or you knowingly and materially breach these Terms, you agree to indemnify us against third-party claims arising from that breach or from unlawful User Content you submit.

This does not apply where prohibited by consumer law, or to the extent a claim is caused by our breach or negligence.

17. Suspension and termination

You may stop using the Service at any time. You can close your account in settings or by emailing hello@jobalchemist.tech.

We may suspend or terminate access if you materially breach these Terms, we reasonably suspect fraud/abuse/unlawful activity, we must comply with law, or continuing would create security/legal risk. We'll usually provide notice where practicable, except in urgent situations.

Data export and deletion:

You may request an export of your User Content for a reasonable period after closing your account (generally about 30 days). We generally delete User Content within about 90 days, subject to backups, legal obligations, dispute resolution, and fraud/security needs (as described in our Privacy Policy).

18. Transfer and assignment

We may transfer or assign our rights and obligations (including as part of an acquisition or restructure). Where appropriate, we'll take reasonable steps to notify you. You may not transfer your rights without our consent.

19. Changes to these Terms

We may update these Terms from time to time. If changes are material, we'll take reasonable steps to notify you (for example, in-app or by email). Material changes generally take effect after reasonable notice (often 30 days), unless we must change sooner for legal or security reasons.

20. Dispute resolution and governing law

These Terms are governed by New Zealand law.

Disputes should generally be brought in New Zealand courts, but nothing in these Terms limits non-excludable rights, including any right you may have to bring proceedings in your local courts or tribunal where required by law (including under the ACL).

Before pursuing any legal action, the parties agree to attempt to resolve disputes through good-faith negotiation for at least 30 days. Mediation is optional.

21. General provisions

Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labour disputes, government actions, failures of third-party infrastructure (internet, cloud providers, AI services), or other events of force majeure.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or tribunal, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and JobAlchemist regarding your use of the Service, and supersede any prior agreements, understandings, or representations (written or oral).

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative.

Relationship

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and JobAlchemist.

Headings

Section headings are for convenience only and do not affect interpretation.
